Title: FIRST READING and possible discussion of Bill No. 2641, PCN11034 – A request to change the existing zoning on a property approximately 0.18 acres in size from Residential Single Family (R1-6) to Professional Office (PO) located at 924 Pyramid Way.

Agenda Item Brief: This request is to rezone from Single Family Residential (R1-6) to Professional Office (PO). The applicant would like to convert the single family home to an office. The property fronts on Pyramid Way and complies with the Master Plan.
Background: On January 19, 2012, the Planning Commission forwarded a recommendation of approval for the zone change on a property approximately 0.18 acres in size from Residential Single Family (R1-6) to Professional Office (PO) located at 924 Pyramid. The surrounding area is a mix of residential and office uses. The proposed rezone to Professional Office (PO) zoning is consistent with the land uses in the area. There are other parcels within the block that are zoned PO. The master plan designates this area along Pyramid Way as Office Professional land use. The area in general is in the process of transitioning from residential uses to professional office type uses because of the increase of traffic and noise along Pyramid Highway. The profession office use is the preferred growth pattern for the future in this area.
Analysis: This request is to rezone from Single Family Residential (R1-6) to Professional Office (PO). The PO district allows professional and medical offices and medical clinics, accessory buildings, banks and other similar financial institutions and in-home child care. REZONING FINDING Z1: The project, as submitted and conditioned, is consistent with the City of Sparks Master Plan. The rezoning is consistent with the Sparks Master Plan. The current Master Plan designation for the property is Office Professional to allow office use. This change in zoning will permit office uses similar to those existing in this area. Relationship to Master Plan 1. The property is located within an area with the Master Plan Land Use Designation of Office Professional. The description of Office Professional states that the equivalent zoning designation is PO (Professional Office). Per the Master Plan document, the Office Professional designation focuses on offices for professional services (emphasis by staff), medical offices, medical clinics, banks, financial institutions or of a general business nature with accessory commercial uses and ancillary uses. Large office parks, child care, drive through businesses and single or multiple family uses as be permitted by discretionary action in these land use areas. The Master Plan document states that Office Professional uses are found scattered throughout the urbanized area but are especially common in and near the vicinity of clinics, hospitals, commercial activities and major streets in the City (emphasis by staff) and the City’s Sphere of Influence Area boundary. These districts function well as buffers between commercial and residential activities. 2. The Land Use Plan Goals and Policies in the 1991 Master Plan update that are also relevant to this proposal include: GOAL LU1: To create a growth pattern which assures flexible, feasible and efficient developments and which includes natural and cultural amenities. POLICIES LU1a. The City will support a preferred growth pattern which applies consistent and uniform standards to areas planned for similar uses. LU1c. The City will approve development plans which address conditions unique to the developing area to minimize impacts to adjacent properties and assure protection of natural and cultural resources. ACTION STRATEGIES 3. Review all projects in relation to their geographic locations, impacts to adjacent communities, fiscal impact and mitigation measures to protect natural and cultural resources. Apply specific conditions of approval tailored for each development proposal. Area Plan Goal 2: Increase Housing Supply and Jobs Growth. While no specific project is being proposed with this rezoning request the change in zoning to Professional Office will increase jobs in this area. Over the years, many of the nearby existing homes have been converted to office use to support the demand for non-residential development on Pyramid Highway. Additionally, as the traffic has increased on Pyramid Highway over the years, this area has become less attractive for residential units due to noise and safety concerns. FINDING Z2: The project is consistent with the surrounding existing land uses. The proposed rezoning is consistent with the surrounding existing land uses as discussed in more detail in Background Section of this Staff Report. FINDING Z3: Public notice was given and a public hearing held per the requirements of the Sparks Municipal Code. Public notice was given and the Planning Commission and City Council meetings function as the public hearings for this item.
Alternatives: FIRST READING
Recommended Motion: Planning Commission and Community Services Department recommends approval. This is a First Reading only. City Council will instruct the City clerk to read the bill by Title on February 13, 2012 and thereby publish Second Reading public hearing of this bill for adoption on February 27, 2012.
