Title: Discussion, candidate interviews and possible confirmation of an appointment by the Mayor to fill the vacancy of Sparks City Council Ward 3 from the following list of candidates listed in alphabetical order: Paul Anderson and Andrea Tavener.

Agenda Item Brief:

On November 13, 2018, Ron Smith was sworn in as Mayor for the City of Sparks. Upon taking the Oath of Office, Mr. Smith officially vacated his office of Sparks Council Member for Ward 3.

The Sparks Charter, under Section 1.070 Elective offices; vacancies, defines the process for appointing and confirming a new member of the Sparks Council.

Mayor Smith defined an appointment process which asked interested parties to apply. The Mayor reviewed the seven applications received and determined he wanted to publicly interview two.

Upon the conclusion of a public interview, which will include the Council’s interaction, the Mayor will appoint one candidate to fill the vacant elected position.

The Sparks Charter requires the Sparks Council to confirm the Mayor’s appointment. If the Sparks Council does not confirm the Mayor’s appointment, a different selection process is defined within the Sparks Charter (Section 1.070., Paragraph 1.).

 



Background:

On June 12, 2018, the primary election was conducted by the Washoe County Registrar of Voters on behalf of the City of Sparks per NRS 293C.110, Ordinance No. 2548 and AC-5436, for the office of Mayor.

Ron Smith received 61.04% of the vote and was declared elected for the office of Mayor.

On November 13, 2018, Ron Smith was sworn in as Mayor for the City of Sparks. Upon taking the Oath of Office, Mr. Smith officially vacated his office of Sparks Council Member for Ward 3.

The Sparks Charter under Section 1.070 Elective offices; vacancies, defines the process for appointing and confirming a new member of the Sparks Council.

Upon the conclusion of a public interview, which will include the Council’s interaction, the Mayor will appoint one candidate to fill the vacant elected position.



Analysis:

The Sparks Charter mandates the following:

Sec. 1.070  Elective offices; vacancies.  Except as otherwise provided in NRS 268.325:

      1.  A vacancy in the City Council or in the office of City Attorney or Municipal Judge must be filled by appointment of the Mayor, subject to confirmation by the City Council, within 30 days after the occurrence of the vacancy. A person may be selected to fill a prospective vacancy in the City Council before the vacancy occurs. In such a case, each member of the Council, except any member whose term of office expires before the occurrence of the vacancy, may participate in any action taken by the Council pursuant to this section. If the majority of the Council is unable or refuses for any reason to confirm any appointment made by the Mayor within 30 days after the vacancy occurs, the City Council shall present to the Mayor the names of two qualified persons to fill the vacancy.



Alternatives:

1. The Council may confirm the Mayor’s appointment of the Sparks Council Ward 3 member.

2. The Council may not confirm the Mayor’s appointment of the Sparks Council Ward 3 member.

3. The Council may not confirm the Mayor’s appointment of the Sparks Council Ward 3 member and follow the next steps in the Sparks Charter (Section 1.070., Paragraph 1.) to fill the vacancy.



Recommended Motion:

I move to confirm the appointment of _________________ as appointed by the Mayor.
