Agenda Item Brief:

The Regional Transportation Commission (RTC) owns the property at 1421 Victorian Avenue.  The Truckee Meadows Water Authority (TMWA) meter that services the property was calibrated incorrectly and meter readings have been overstated by a factor of 10.  Due to the overstated TMWA meter readings, RTC is requesting a refund of $37,166.39.



Background:

The Regional Transportation Commission owns the property at 1421 Victorian Avenue.  The Truckee Meadows Water Authority (TMWA) meter that services the property was calibrated incorrectly since 2008 when the meter was placed and meter readings have been overstated by a factor of 10.  Sparks commercial sewer is billed monthly using the TMWA water meter readings.  The Customer Service division was made aware of the meter error in February 2017 and completed an adjustment.  The billings were adjusted for three years per NRS 11.190 that limits the liability of discovered mistakes.  Due to the overstated TMWA meter readings, a credit $37,166.39 to the Regional Transportation Commission’s account is recommended.  The customer has requested a refund in full.  



Analysis:

Reference - Sparks Municipal Code section 2.27.030 requires all settlements over $25,000 be approved by City Council.



Alternatives:

City Council could deny the refund and provide direction.



Recommended Motion:

I move to approve a refund to the Regional Transportation Commission in the amount of $37,166.39.
