Title: Public Hearing, consideration and possible approval of a request from Gurr Family Trust to the City of Sparks for the abandonment of an alleyway situated to the north of Glendale Avenue, south of Shaber Avenue, east of Rock Boulevard and west of South 16th Street.

Recommendation: Staff recommends the Council approve the request of the alleyway abandonment (AB-140).

Agenda Item Brief:

Gurr Family Trust has made a request to the City of Sparks for the abandonment of an alleyway situated to the north of Glendale Avenue, south of Shaber Avenue, east of Rock Boulevard and west of South 16th Street (see attached site Plan).  Staff has researched the request and is of the opinion that the public will not be materially injured by the proposed abandonment and recommends approval.



Background:

Gurr Family Trust is the owner of property on either side of the alleyway.  Gurr Family Trust is in the process of developing the existing site and has requested that the Sparks City Council consider the abandonment of an alleyway situated to the north of Glendale Avenue, south of Shaber Avenue, east of Rock Boulevard and west of South 16th Street.  Gurr Family Trust intends to develop the site with a proposed fueling station.



Analysis:

The legal descriptions (see attached) for the requested alleyway abandonment have been reviewed by staff and have been found acceptable.  Each owner of property abutting the proposed abandonments have been properly notified via certified mail as required by NRS 278.480 (4) (a).  The extent of the proposed abandonment and the date of the public hearing were published in the Reno Gazette Journal as required by NRS 278.480 (4) (b).  Reservations of easement (per NRS278.480 (6)) are included where applicable.  Staff finds that the public will not be materially injured by the proposed abandonments and recommends approval.



Alternatives:
  1. The City Council could approve the request for abandonment as outlined by Staff.
  2. The City Council could deny the request for abandonment as outlined by Staff.


Recommended Motion:

I move to approve the request from Gurr Family Trust to the City of Sparks for the abandonment of an alleyway as outlined by staff.
