Agenda Item Brief:

This is a request by Cemex Construction Materials Pacific, LLC to rezone a site approximately 4.32 acres in size located at 350 Galletti Way from TC (Tourist Commercial) to I (Industrial).  This rezoning request is in conformance with the Master Plan and is appropriate for the location.  The site is located across Galletti way from the current Cemex concrete batch plant location in Reno.  Staff made all of the findings and recommended approval to the Sparks Planning Commission. At their March 3, 2016 meeting, the Sparks Planning Commission voted to forward a recommendation of approval to the Sparks City Council.  The first reading of Bill 2707 for tis rezoning was preformed at the June 13, 2016 City Council meeting. 



Background:

BACKGROUND

Cemex currently operates a concrete batch plant at 333 Galletti Way in Reno.  The site that is the subject of this application is locate directly across Galletti Way in Sparks.  The Sparks site is currently operated as a material and general storage site for the concrete batch plant across the street.

Cemex would like to replace their existing plant with a new plant.  As part of this project Cemex is proposing to remove the existing plant from the Reno site (which is smaller) and construct a new plant across the street at 350 Galletti Way in Sparks. 

The subject site is currently zoned TC (Tourism Commercial), which does not allow a concrete plant.  Cemex is proposing to rezone the property to I (Industrial).      

A companion Master Plan Amendment (MPA) has been submitted by the applicant for this site.  The Planning Commission has forwarded a recommendation of approval to the City Council for the MPA (this item will be heard as a public hearing item at the June 23 City Council Meeting as will the second reading of this rezoning request).  The Regional Planning Commission has found the MPA request to be in conformance with the Regional Plan.



Analysis:

ANALYSIS

This site has served as parking and storage for the concrete plant across the street since 1997 (Valley Concrete at that time).  The applicant has informed City staff that development of the Sparks site as a concrete plant will not be in addition to but in replacement of the plant on the Reno side of the street.  As such, while the traffic pattern may change to some degree, traffic volume should not change significantly. 

The existing zoning (TC) is not being utilized for its intended purposes.  A transition to Industrial zoning is logical due to the Industrial zoning adjacent in Reno and nearby location of the NDOT construction yard. 

Traffic concerns have been voiced by both City staff and NDOT.  The applicant asserts that they will not increase traffic from its existing level.  Site planning issues regarding how the plant may operate if and when it is relocated to the Sparks site will be considered during an Administrative Review process which will be required before any new construction would be allowed.     

REZONING

FINDING Z1:

The project, as submitted and conditioned, is consistent with the City of Sparks Master Plan.

The rezoning to I will be appropriate if the requested Master Plan Amendment, a companion application to this request, is approved.   

FINDING Z2:

The project is consistent with the surrounding existing land uses.

The proposed rezoning is consistent with the surrounding existing land uses.  This site is in a developed semi-industrial area of Sparks.  The site is adjacent to I-80 and the NDOT equipment yard which are both of similar nature in terms of land use.  The adjacent Department of Motor Vehicles is also not incompatible with this use.

FINDING Z3:

Public notice was given and a public hearing held per the requirements of the Sparks Municipal Code.

Public notice was given and the Planning Commission and City Council meetings function as the public hearings for this item.

I move to adopt Bill No. 2707 and approve the Rezoning request associated with PCN15067 to rezone a site approximately 4.32 acres in size from TC (Tourist Commercial) to I (Industrial), based on the findings Z1 through Z3, and the facts supporting these findings as set forth in the staff report.
