Agenda Item Brief:

On January 26, 2015 the Sparks City Council granted approval to Bill No. 2689, an ordinance amending Chapter 12 of the Sparks Municipal Code to, among other matters, adopt the 5th Edition of the General Administrative Manual of the Regional Transportation Commission Regional Road Impact Fee System.

On April 15, 2016 the Regional Transportation Commission Board approved Amendment No.1 to the 5th Edition of the General Administrative Manual of the Regional Transportation Commission Regional Road Impact Fee System.  Amendment No.1 to the General Administrative Manual added language, method and procedures to extend the expiration date of existing Capital Contribution Front Ending Agreement (CCFEA) Credits by 10 years beyond current expiration dates.

Sparks Municipal Code 12.44.030 allows for subsequent amendment to the General Administrative Manual by resolution of the City of Sparks City Council.

Approval of this resolution will adopt Amendment No.1 to the 5th Edition of the General Administrative Manual of the Regional Transportation Commission Regional Road Impact Fee System.

 

 



Background:

On September 19th, 2014, the Regional Transportation Commission Board approved the 5th Edition of the General Administrative Manual of the Regional Transportation Commission Regional Road Impact Fee System.  The 5th Edition of the General Administrative Manual sets forth the rules, methods and procedures for the implementation of the Regional Road Impact Fee System.  With the approval of the 5th Edition of the General Administrative Manual, the RTC Board instructed staff to present the 5th Edition of the General Administrative Manual to the City of Sparks City Council for approval.

On January 26, 2015 the Sparks City Council granted approval to the second reading of Bill No. 2689, an ordinance amending Chapter 12 of the Sparks Municipal Code to, among other matters, adopt the 5th Edition of the General Administrative Manual of the Regional Transportation Commission Regional Road Impact Fee System.

On May 26, 2015, the Sparks City Council approved Resolution 3276 adopting Amendment No. 1 to the 5th Edition of the General Administrative Manual of the Regional Transportation Commission Regional Road Impact Fee System.  The effective date of resolution 3276 was "May 27, 2015 or at such time that similar adoption is completed by the Washoe County Board of County Commissioners and the City of Reno City Council, whichever comes last."   Amendment No 1 was approved by the Washoe County Board of County Commissioners but approval was delayed by the Reno City Council.

On March 23, 2016 the Reno City Council approved Amendment No. 1 to the 5th edition of the General Administrative Manual.

Because the inital amendment approved by the RTC Board, Washoe County Board of County Commissioners and Sparks City Council differs from the amendment that was approved by the Reno City Council, the RTC Board instructed staff to present the revised Amendment No. 1 of the 5th Edition of the General Administrative Manual to the City of Sparks City Council for approval (See attached letter from RTC).

Sparks Municipal Code 12.44.030 allows for subsequent amendment to the General Administrative Manual by resolution of the Sparks City Council.  

 



Analysis:

Amendment No. 1 to the 5th Edition of the General Administrative Manual adds language, methods, and procedures to extend the expiration date of existing Capital Contribution Front Ending Agreement (CCFEA) Credits by 10 years beyond current expiration dates.  The method and procedures for the extension of CCFEA Credits are included in Section XI (F), page 46, of Amendment No. 1 and generally include:

  • Conversion Period - Existing CCFEA Credit holders must elect to exchange their CCFEA Credits for Extension Credits during a 90 calendar day conversion period beginning on a business day determined by the RIFF administrator.  Holders of CCFEA credits will not be allowed to exchange credits after the conversion period.
  • Notice of Conversion Period- The RTC will mail existing CCFEA credit holders notice of the conversion period.  The RTC shall also publish notice of the conversion period in a qualified newspaper within Washoe County at least 3 times prior to the expiration of the Conversion Period.
  • Election to Extend - In order to exchange CCFEA credits for Extension Credits, CCFEA credit holders must give written notice to the RTC Regional Road Impact Fee (RRIF) Administrator during the Conversion Period.
  • Exchange Fee - The RIFF administrator shall require each exchanging credit holder to pay an exchange fee of $500 upon application for exchange.
  • CCFEA Amendment - In order to complete the exchange of CCFEA Credits for Extension Credits, the CCFEA Credit holder, the RTC, and each Participating Local Government which was a party to the original CCFEA pursuant to which the exchanged CCFEA Credits were originally issued, will enter into a CCFEA amendment extending the CCFEA Credits for an additional ten (10) years beyond the original expiration date of the exchanged CCFEA Credits.
  • RRIF Automation Account- All Extension Credit Holders shall participate in the RIFF automation program and will be issued a new account for their Extension Credits.
  • Issuance of Extension Credits - Upon receipt of a valid election to extend, payment of the applicable exchange fee, amendment of the applicable CCFEA, and creation of the applicable RRIF Automation
    Account, the exchanged CCFEA Credits shall be extinguished and an equal number of Extension credits shall be issued.

 



Alternatives:
  1. The City Council may approve the resolution as submitted by staff
  2. The City Council may reject the resolution and provide direction to the City Manager


Recommended Motion:

"I move to approve Resolution No. 3294 adopting Amendment No. 1 to the 5th Edition of the General Administrative Manual of the Regional Transportation Commission Regional Road Impact Fee System."
