On June 22, 2015, the Sparks City Council considered and approved the Victorian Square Property Exchange Agreement (Agreement). The Agreement requires, among other things, the City of Sparks to vacate portions of street right-of-way abutting parcels of land located in Victorian Square (see attached site plan). Consideration and approval of the conditional order vacating street right-of-way attached to this report will fulfill a portion of the City's obligations included in the Agreement. Staff has researched the request and is of the opinion that the public will not be materially injured by the proposed order vacating street rights-of-way and recommends approval.
Background:
On June 22, 2015, the Sparks City Council considered and approved the Victorian Square Property Exchange Agreement (Agreement). Article 2 of the Agreement (attached) requires, among other things, the City of Sparks to vacate portions of street right-of-way abutting parcels of land located in Victorian Square (see attached site plan). Consideration and approval of the conditional order vacating street right-of-way attached to this report will fulfill a portion of the City's obligation included in the Agreement.
Analysis:
The legal descriptions (see attached ) for the requested right-of-way abandonments have been reviewed by staff and have been found acceptable. Each owner of property abutting the proposed vacation of rights-of-way have been properly notified via certified mail as required by NRS 278.480 (4) (a). The extent of the proposed vacation of rights-of-way and the date of the public hearing were published in the Reno Gazette Journal as required by NRS 278.480 (4) (b). Reservations of easment are included in the order vacating the right-of-way as allowed by NRS 278.480 (6). Staff finds that the public will not be materially injured by the proposed vacation of rights-of-way and recommends approval.
Alternatives:
- The City Council could approve the order vacating street right of way as outlined by Staff.
- The City Council could deny the order vacating street right of way as outlined by Staff and provide direction to the City Manager.
Recommended Motion:
"I move to approve the conditional order vacating street right-of-way with reservation of easements for rights-of-way located in Victorian Square as submitted by staff"
