Title: Pursuant to NRS 241.033 and City Manager’s Employment Agreement a review by City Council of City Manager Stephen Driscoll’s performance as City Manager, including character and professional competence as it relates to his performance as City Manager, and to discuss and possibly approve an extension of his Employment Agreement through 7/31/2016 and consideration and possible approval of a salary adjustment.

Recommendation: Approval of an extension of the City Manager Employment Agreement through July 31, 2016 with a salary adjustment as mutually agreed to with the Council and the City Manager.

Agenda Item Brief:

The Employment Agreement for Stephen Driscoll, City Manager, allows for City Council to review his performance on an annual basis. The Mayor and Council Members were asked to provide performance feedback on Mr. Driscoll’s performance as City Manager. A review of the performance results will be presented to Council for their consideration with a request for extension of the Mr. Driscoll’s employment agreement and possible salary adjustment.



Background:

Section 6 of City Manager Steve Driscoll’s Employment Agreement requires that the  Mayor and City Council  review and evaluate the MANAGER's performance and salary on an annual basis Pursuant to the Agreement, the City Council may  adjust the  Manager's salary as mutually agreed with the Manager.

The contract further provides that if City Council takes no action on the Manager's contract by July 1 in any year, the contract will automatically renew for a one (1) year term under the same terms and conditions set forth herein.



Analysis:

Performance Evaluation

To facilitate the process, the Mayor, and City Council, were asked to provide performance feedback to Mindy Falk, Human Resources Manager. A summary of these performance reports is attached as “City Manager Review.”

Salary Analysis

The Human Resources Department has conducted a total compensation market analysis of other City Manager's in Northern Nevada.  This report is also attached.  Currently, the City Manager is eight percent above the market. Which is slightly above the City’s goal of total compensation plus or minus five percent.

Excecutive Resolution

On June 8, 2015 Council granted the employees in the executive resolution a 2% cost of living allowance effective the first full pay period after July 1, 2015.  Council may want to consider giving the City Manager a similar allowance to stay consistent with pay practices.

 



Alternatives:

The City Council may take one of the following actions:

1. Renew the City Manager employment agreement and make an adjustment to the City Manager's salary as mutually agreed to with the Council and the City Manager.

2. Renew the City Manager employment agreement and make no adjustment to the City Manager's salary .

3. Not renew the City Manager employment agreement.

4.  Provide other direction to Staff.
