Title: Public Hearing, Consideration and possible approval of a request from William D Phillips Family Revocable Trust to the City of Sparks for the abandonment of a portion of the 18th Street right of way and for the abandonment of a portion of the I Street Right abutting 1025 18th Street.

Agenda Item Brief:

William D Phillips Family Revocable Trust is the owner of 1025 18th Street and has requested that the City of Sparks City Council consider the abandonment of a portion of the right of way associated 18th Street and the abandonment of a portion of the right of way associated with I Street abutting the property (see attached site plan).  Staff has researched the request and is of the opinion that the public will not be materially injured by the proposed abandonments and recommends approval.



Background:

William D Phillips Family Revocable Trust is the owner of 1025 18th Street and has requested that the City of Sparks City Council consider the abandonment of a portion of the right of way associated 18th Street and the abandonment of a portion of the right of way associated with I Street abutting the property (see attached site plan).  Staff has researched the request and is of the opinion that the public will not be materially injured by the proposed abandonments.



Analysis:

The legal descriptions (see attached ) for the requested right of way abandonments have been reviewed by staff and have been found acceptable. Each owner of property abutting the proposed abandonments have been properly notified via certified mail as required by NRS 278.480 (4) (a). Each public utility and video service providers were provided written notice of the proposed abandonment as required by NRS 278.480 (6). The extent of the proposed abandonment and the date of the public hearing were published in the Reno Gazette Journal on May 1, 2015 as required by NRS 278.480 (4) (b). Per the request of notified public utilities and video service providers, a reservation of easement is included in the order of abandoment (attached).



Alternatives:
  1. The City Council could approve the request for abandonment as outlined by Staff.
  2. The City Council could deny the request for abandonment as outlined by Staff.


Recommended Motion:

"I move to approve the abandonment of a portion of the 18th Street right of way and for the abandonment of a portion of the I Street right of way abutting 1025 18th street as submitted by Staff"
