Agenda Item Brief:

Discussion and possible approval of a Memorandum of Understanding (“MOU”) between the City of Sparks, Nevada, a municipal corporation (“City”), and the International Association of Firefighters Local No. 1265 (Firefighters).



Background:

The City and Firefighters entered into a multi-year collective bargaining agreement (CBA) for the period beginning July 1, 2012, through June 30, 2015, which was approved by the Sparks City Council on July 9, 2013. Following implementation, it was found that the Section 4, Article I - Compensatory Time was not compatible with the Fair Labor Standards Act (FLSA) in regards to Compensatory Time 'banks'. The FLSA limits the number of hours to be banked to a total of 480 hours. The contract, as written, has two banks, for a total of 960 hours. It is necessary to modify the agreement to limit the hours to comply with FLSA regulations. In addition, several sections have been modified to better clarify contract language. These sections are: Section 2, Article C Overtime Pay; Section 2, Article D Educational Incentive Pay; Section 2, Article G Stand By Pay.  Article 4, Section C Sick Leave was modified to eliminate the minimum hours taken provision for 40 hour employees to facilitate the new timekeeping system.  Lastly, Section 4, Article I Compensatory Time reduced the minimum hours taken.

1. The Council may choose to approve the Memorandum of Understanding between the City and the International Association of Firefighters Local No. 1265 (Firefighters) as outlined by staff.

2. The Council may choose not to approve the Memorandum of Understanding between the City and the International Association of Firefighters Local No. 1265 (Firefighters). as outlined by staff.

3. The Council may direct staff to another alternative.



Recommended Motion:

I move to approve the Memorandum of Understanding between the City and the International Association of Firefighters Local No. 1265 (Firefighters).
