Title: Consideration and possible action on Resolution No. 3255, revising fees for development services provided by the City of Sparks and specifically considering fees for Administrative Review applications.

Agenda Item Brief: To facilitate development and growth in the City of Sparks, the City is considering adding an “administrative” process for review of certain uses. This resolution is a companion agenda item to establish fees. The proposed fee for Administrative Review is a deposit of $1,250; staff time will be charged at $120 per hour, not to exceed $7,495.


Background:

The Development Services Enterprise Fund (DSEF) was created by City Council action in 1999. The intent was to have the development community pay for services the City provides to review, entitle, permit and inspect land use approvals and development activity. Services included in the fund range from Planned Developments to Special Use Permit review. Last year, the City Council approved a resolution amending the fees for Special Use Permits, Site Plan Reviews, Code Amendments, and Tentative Maps with a time and materials billing mechanism. A deposit of $2,500 is currently required for Special Use Permits and $1,250 for Site Plan Reviews and Tentative Maps. All have a not to exceed limit of $7,495. The Council also approved keeping the “Major” Special Use Permit which requires a deposit of $10,000 credited toward actual staff time. In November 2013, City Council approved new fees for minor deviations at $120 and deposit of $1,250 plus a $500 noticing fee for major deviations.



Analysis:

The purpose and intent of the administrative review is to evaluate certain uses to determine whether the proposed use will conform to the zoning ordinance, City codes and other applicable City ordinances. The administrative review process will allow reviewing agencies to assess the proposed use to insure that it is aesthetically acceptable and serves the interest of the public health, safety and general welfare of the City. Administrative Review will be used to assess medical marijuana cultivation facilities, independent testing laboratories, facilities for the production of edible marijuana products or marijuana-infused products and other uses with operational criteria in Title 20 of the Sparks Municipal Code. On April 16, 2014, the Enterprise Fund Advisory Committee meeting will review the new application process for Administrative Reviews and the fee to process these applications. Staff recommends a deposit of $1,250 for processing the Administrative Reviews processing with a maximum of $7,495. Resolution No. 3255 has been attached to this staff report and the fees are listed.



Alternatives: City Council cannot approved the new fee for Administrative Reviews.

Recommended Motion: I move to adopt Resolution No. 3255 revising fees related to development services provided by the City of Sparks for Administrative Review.
