Title: Consideration and possible approval of an Interlocal Agreement (AC-5019) between the City of Sparks and Washoe County to allow for the Conducting and Holding of the 2014 Primary and General Elections.
Petitioner/Presenter: Teresa Gardner, City Clerk/Donna DiCarlo, Assistant City Clerk / Records Coordinator
Recommendation: Approve the Interlocal Agreement to allow Washoe County Registrar of Voters to conduct and hold the 2014 Primary and General Elections for the City of Sparks’ citizens.
Financial Impact: Not to exceed $35,000
Business Impact (Per NRS 237):

A Business Impact Statement is not required because this is not a rule.
Agenda Item Brief:

In 2001 the Charter Committee presented the Nevada Legislature with a Bill Draft Request to amend the city’s Charter to conduct all Sparks’ Municipal Elections concurrent with the Federal and State Primary and General Elections in the even numbered years. Washoe County has been conducting Elections on behalf of the City of Sparks since 2002. The Interlocal Agreement is to authorize the Washoe County Registrar of Voters to conduct the 2014 Primary and General Elections for the City of Sparks.

Background:

Pursuant to Sparks City Charter, Article V, Section 5.030, the conduct of all elections must be under the control of the City Council. For the conduct of elections, for the prevention of fraud in elections, and for the recount of ballots in cases of doubt or fraud, the City Council shall adopt by ordinance all regulations which it considers desirable and consistent with law and this Charter.

Pursuant to NRS 293C.110, except as otherwise provided in subsection 2, conduct of any city election is under the control of the governing body of the city, and it shall, by ordinance, provide for the holding of the election, appoint the necessary election officers and election boards and do all other things required to carry the election into effect.

Analysis:

Sparks' Charter allows the city to contract with Washoe County to include our election on their Primary and General Election Ballots. In conducting the elections in this manner the city shall pay to the county $.15 per registered city voter. In addition, the city shall be responsible for payment of actual costs for conduct of the city’s portion of the election, incurred by county in the performance of the agreement, which would not otherwise have been incurred by the county.

Alternatives: The City Council could direct staff to conduct the city’s election as a stand-alone election at a substantially higher cost.

Recommended Motion: I move to approve the Interlocal Agreement AC-5019 to provide for the conducting and holding of the Primary and General Elections for 2014.
