Recommendation: Staff recommends that the City Council approve payment totaling $58,258 to W. Keith Mentzer, Trustee of the Keith Mentzer and Edith Page Mentzer Family 1991 Trust for Temporary Construction Easement and Storm Drain Pipeline Easement for the North Truckee Drain Project.
Financial Impact: $58,258 in Storm Drains Capital Fund 1641. $12,000,000 was approved for Project 14-6820 North Truckee Drain Relocation Phase 1 in the FY14 CIP, of which $1,384,756 of budget authority remains. On October 14, 2013, City Council approved an agreement with Truckee River Flood Management Authority whereby Truckee River Flood Management will reimburse City of Sparks $4,750,000 for North Truckee Drain Relocation construction costs. The construction contract in the amount of $9,165,013 was awarded to Q&D Construction in the December 9, 2013 Council Meeting. Of that $9.165M amount, $4,750,000 is reimbursable from Truckee River Flood Management Authority.

Agenda Item Brief: Construction of the North Truckee Drain realignment project will require substantial acquisition of easements and right-of-way for both construction access and permanent facilities. The property owner associated with this item is affected by future portions of the project, and an offer totaling $58,258 for easements was presented and accepted by the property owner. Approval of the payments is being presented for consideration by City Council. Staff recommends approval.


Background: In order to construct the North Truckee Drain Realignment project, numerous easements will be required to establish Temporary Construction Easements and Storm Drain Pipeline Easements. A total of 18 parcels are identified as having easement impacts, comprised of a minimum of 12 unique owners. On June 11, 2012, City Council approved a contract with Warren and Schiffmacher to prepare appraisals of the subject properties in order to proceed with construction of the North Truckee Drain Realignment project. All easements within the Phase 1 construction limits have been acquired; the subject easements being acquired under this transaction are within the future “Phase 3” area of the project. With this acquisition, 2 property owners remain for easement acquisition as shown on the attached Exhibit. Upon completion of the Appraisal, Review Appraisal, and numerous site and office visits with the owner of the parcel affected by this staff report the necessary documents were prepared. For this property, two easements were acquired: a Temporary Construction Easement and a Storm Drain Pipeline Easement.

Analysis: The Easement areas required to construct and operate the North Truckee Drain project have been carefully considered to ensure project needs are met while reducing property impacts. Offer valuations for the temporary and storm drainage pipeline easements were determined using the Uniform Standards of Professional Appraisal Practice. Appraisal review was provided by Kimmel and Associates with no concerns noted.

Alternatives: 1. City Council could approve the Payment as outlined by Staff. 2. City Council could reject the Payment and provide direction to the City Manager

Recommended Motion: I move to approve the payment totaling $58,258 to W. Keith Mentzer, Trustee of the Keith Mentzer and Edith Page Mentzer Family 1991 Trust for Temporary Construction Easement and Storm Drain Pipeline Easement for the North Truckee Drain Project.
