Title: Consideration and possible approval of the abandonment of an approximate 12 foot by 30 foot, portion of the south side of Disc Drive right of way adjacent to Parcel 4 Parcel Map 4978, being the 8th Parcel Map for Sparks Galleria Investors, LLC granted to the City pursuant to Dedicated Tract Map No. 4340, as recorded May 12, 2004.

Recommendation: Staff recommends Council approve the abandonment of the approximate 12 foot by 30 foot portion of Disc Drive right of way adjacent to Parcel 4 Parcel Map 4978 as granted to the City by Dedicated Tract Map No. 4340 recorded May 12, 2004, as further described in the attached Exhibit “A” and as depicted on Exhibit “B”.

Agenda Item Brief: Consideration and possible approval of a request from Sparks Galleria Center, LLC to abandon an approximate 12 foot by 30 foot portion of the south side of Disc Drive right of way granted to the City as Dedicated Tract Map 4340 containing an area of 358 square feet, as further described in the attached Exhibit ”A.” and as depicted in the Attached Exhibit “B” Staff recommends approval.


Background: The width of road right of way on Disc Drive is 112 feet. The owner of the Signage Easement Document No. 3239437 has requested the abandonment of approximately 12 feet by 30 feet adjacent to his existing property. The property requested for abandonment is all located behind the existing curb line and behind the sidewalk. The Owner, through an ALTA survey, discovered a portion of his approved signage was actually located on City right of way. This proposed abandonment will resolve the signage issue.

Analysis: Staff recommends the Council approve the abandonment request from Sparks Galleria Center, LLC to vacate the approximately 12 foot by 30 foot portion of the south side of disc Drive, as described in the attached Exhibit “A.” and as depicted in the attached Exhibit “B” The road right of way proposed for abandonment is not required for road purposes now or in the immediate future. The abandonment of the road right of way will return a 358 square feet parcel to the tax rolls, and resolve a signage issue.

Alternatives: 1. The City Council could approve the abandonment as outlined by staff. 2. The City Council could reject the abandonment and provide direction to the City Manager. 3. The City Council could direct the City Manager to provide alternatives to this proposal.

Recommended Motion: “I move to approve the vacation of a portion of Disc Drive as outlined by staff.”
